General

1. Go People provides the Sender with an opportunity to purchase a warranty against loss or damage to the Sender’s goods while the goods are in the possession of a Runner (the “Goods”), subject to the limitations and exclusions set out hereunder (the “FreightSafe Warranty”). All FreightSafe Warranties are governed by the General Terms and Conditions for Senders, these terms and conditions, and the details regarding the cost and different types of warranty cover available through the FreightSafe Warranty which can be found here: https://www.gopeople.com.au/freightsafe-about/.

2. The FreightSafe Warranty ‘B’ Level of Cover applies by default to all Goods consigned using the GoVIP and GoSAMEDAY Service on each Sender’s account. The FreightSafe Warranty will only apply to the GoSHIFT Service once the Sender selects a FreightSafe Warranty Level of Cover. Senders can select which FreightSafe Warranty Level of Cover will apply to each delivery through the GoPeople platform.

3. The FreightSafe Warranty is in place from when the Goods are first moved outside of the premises at which loading takes place for the purpose of being immediately loaded onto the conveying vehicle, ending when the Goods are last moved when being delivered at the destination point associated with the freight booking, or any earlier point where the ordinary course of transit has been interrupted.

4. In the circumstances where the loss or damage to Goods is partly caused by an event or incident that is the responsibility of GoPeople under these terms and conditions, but also partly caused by an event outside its reasonable control, GoPeople will assess the extent to which its actions or inactions have caused or contributed to the loss or damage suffered by the Customer and the extent to which the loss or damage was caused by something that was not within the control of GoPeople (i.e. a natural disaster event). Claims under the FreightSafe Warranty will be assessed on this basis and an offer to compensate the Customer will be made for the share of responsibility that GoPeople has for causing or contributing to the loss or damage.

FreightSafe Warranty Claims

5. Any claim under the FreightSafe Warranty for damage to or loss of Goods (“Claim”) must be made via online claim form or in writing on a claim form supplied by Go People. Claims must be sent via:-

6. The Sender must notify Go People in writing of any Claim within the following time limits:

  1. where the Receiver has indicated in writing on the proof of delivery, within three (3) business days from the date of delivery of the Goods to the Delivery Address; and
  2. in respect of Claims for non-delivery, within three (3) business days after the date of dispatch specified for that job.
  3. The Sender is required to notify GoPeople directly of any loss or damage to goods as the first point of contact, prior to initiating any claim.

7. Claims must be lodged online within thirty (30) calendar days from the notification date of loss or damage to the consignment.

8. The Sender may only make one (1) Claim per job.

9. The Customer must provide to the claims administrator, FreightSafe, with any Claim, documentary evidence acceptable to GoPeople and FreightSafe as proof of value of the Goods. This may include, but is not limited to, the supplier’s invoice or evidence of actual cost of manufactured goods, as well as a sales invoice where applicable.

10. Where the Sender makes a valid Claim, GoPeople reserves the right to pay the Claim either directly to the Sender by cheque or EFT or as a credit note to the Sender’s account.

11. Claims will only be paid by GoPeople in respect of any Claim after the Sender has paid all outstanding amounts owed by the Sender to GoPeople on their account.

FreightSafe Warranty Limitations

12. The FreightSafe Warranty is subject to the following limitations:

  1. Claims are limited to loss of or damage to the Goods only. For the avoidance of doubt, the FreightSafe Warranty does not cover any consequential loss or damage suffered by the Sender as a result of loss or damage to the Goods.
  2. The maximum amount that may be claimed from GoPeople under the FreightSafe Warranty is the lesser of:
    1. the FreightSafe Warranty limitation amount of either $100, $250 or $1,000, as selected and paid for by you; and
    2. the cost price of the Goods, as supported by documentary evidence acceptable to GoPeople (for example copy of the supplier’s invoice or evidence of actual cost of manufactured goods).
  3. Where there is no invoice value for the original purchase price (cost) of the goods, 65% of the sales/retail value of the item will be used as the basis of valuation.
  4. GST and freight charges relating to the job covered by the FreightSafe Warranty shall not be included in the calculation of any amount payable under the FreightSafe Warranty in respect of the Goods and any payment by GoPeople arising out of any Claim made by the Sender will be exclusive of GST.
  5. Where a Claim has been paid in full for damaged Goods, GoPeople reserves the right to take possession of the Goods as salvage and to dispose of such Goods as it sees fit.
  6. In the event that there is no visible evidence of damage occurring during Carriage, or GoPeople and FreightSafe determine that the condition of the goods post-delivery was likely the condition that preceded the commencement of Carriage or the Runner taking possession of the Goods, Claims for damage will not be paid unless the Customer can supply reasonable evidence of the condition of the Goods prior to Carriage.

FreightSafe Warranty Exclusions

13. The FreightSafe Warranty will not cover any Claims made by Senders in any of the following circumstances:

  1. where the Sender has not paid all charges in connection with the delivery of the relevant Goods;
  2. Where GoPeople’s records confirm successful delivery, including goods claimed as lost following an authorised unattended delivery (delivered with an Authority to Leave);
  3. Where GoPeople’s records reflect that the consignment was not duly collected or the collection process remains incomplete;
  4. where the Goods consigned are Excluded Goods, where “Excluded Goods” means any of the following items:-
    1. currency; negotiable instruments; jewellery; gemstones; precious metals; antiques; works of art; securities; drugs; weapons or living animals; household and personal effects; second hand goods, cigarettes, tobacco and tobacco products; valuable documents; glass or glass products.
  5. Where the Goods have not been packed in the original manufacturer’s packaging or the equivalent, and/or in the reasonable opinion of GoPeople or FreightSafe, the packaging of the Goods did not comply with the Packaging Guidelines or other industry standard relevant to the nature of the Goods or is otherwise of an insufficient standard to withstand the transit of the Goods for road, rail, sea or air transportation;
  6. Where the Goods were not adequately labelled or no label exists on the consignment;
  7. Where damage or loss to the Goods is attributable to electrical, chemical or mechanical failure or other operational defect in the Goods which could not, in the reasonable opinion of GoPeople and FreightSafe, have been caused by the Carriage;
  8. where GoPeople fails, delays or is unable to carry out its obligations under this contract due to strikes and / or lockouts (whether of GoPeople’s own employees or those of others and whether or not GoPeople could have avoided the same by acceding to the demands of the employees responsible for such action), acts of God, war, terrorism, fire, flood, embargo, litigation, acts of government or any agency instrumentality or any political subdivision thereof or any other cause beyond the control GoPeople;
  9. where the goods have been lost or damaged as a result of derailments;
  10. where GoPeople or the Runner has complied with the Sender’s reasonable written instructions for the safe-handling, transportation and storage of the Goods; and
  11. Where the delivery address is a post office box, a roadside drop or postal mailbox and GoPeople considers this means the consignment could be reasonably accessible by someone other than the intended recipient/addressee of the consignment.

Amendments to Terms and Conditions of Contract

14. GoPeople reserves the right to amend these terms and conditions of contract from time to time, without prior notice to the Sender. The terms and conditions apply to a FreightSafe Warranty is the version of these terms and conditions effective at the time the FreightSafe Warranty is purchased.

Definitions

Carriage means transport of the Goods by GoPeople, its contractors or agents, as applicable.

Cost Price means the lesser of:
• the Customer’s original purchase price;
• the repair cost; and
• the replacement cost.

Customer means the person or entity who engages GoPeople (or their contractors or agents, as applicable) to transport Goods.

FreightSafe means FreightWise Services Pty Ltd (trading as FreightSafe) ACN 101 566 465

Packaging Guidelines as prepared by GoPeople means the best practice guidelines for packaging prepared by FreightSafe as amended from time to time and available at https://www.gopeople.com.au/packaging-guidelines/

Goods means the items the Customer engages GoPeople (or their contractors or agents, as applicable) to transport.

Warranty means the FreightSafe Warranty offered to the Customer by GoPeople pursuant to these terms and conditions.
