1. ADDITIONAL TERMS AND CONDITIONS
1.1 These additional terms and conditions (the “Additional Terms”) are to be read in conjunction with the General Terms and Conditions for Runners (the “General Terms”) which can be found at www.gopeople.com.au/terms-for-runners/.
1.2 Go People has entered into an agreement with Woolworths Group Limited ABN 88 000 014 675 (“WOW”) to provide home delivery services under a pilot program for a period of 90 days with effect from 6 February 2023 (“Pilot Program”). These Additional Terms and Conditions apply to each Runner who agrees to participate in the Pilot Program.
1.3 Words which are defined in the General Terms have the same meaning in these Additional Terms unless the context requires otherwise.
2. WOW SERVICES
2.1 The home delivery services to be provided under the pilot program (“WOW Services”) involve:
- a WOW customer placing an online order with WOW;
- WOW picking that order and then arranging with Go People for a Runner to collect the goods from a location where they will be physically delivered by WOW to the relevant Runner, or collected by the relevant Runner, in a designated waiting area (“Load Point”); and
- Runners delivering the goods as directed to a designated business or residential address, or any other location as WOW may notify Go People from time to time.
3. ACCEPTING WOW SERVICES ORDERS
3.1 By accepting an order with Go People through the Application to provide WOW Services, you represent and warrant to Go People that:
- you will use your vehicle exclusively for WOW during the period you are engaged to provide the WOW Services;
- you will comply with any statute, ordinance, code or other law, including regulations and contract determinations under them as applicable in each relevant State and Territory (“Relevant Laws”);
- you have fully read, understood and fully agree to comply with:
- the Australia New Zealand Food Standards Code;
- any of WOW’s policies as notified by WOW or Go People to you from time to time, including but not limited to:
A. WOW’s Privacy Policy located at: https://www.woolworthsgroup.com.au/page/privacy-policy/; and
B. WOW’s Third Party Service Provider – Cyber Security and Technology Control Standards;
- you have successfully:
- completed any training or courses required by Go People or WOW (including without limitation any safety, driver, cyber security or technology related training or courses); and
- obtained any necessary permits, approvals, authorisations, licenses or certifications to the full satisfaction of Go People;
- to the extent the WOW Service involve the delivery of alcohol, you will comply with and follow the Responsible Service of Alcohol training and certification requirements of the state or territory where you will be providing the WOW Services;
- you will comply with any reasonable directions from Go People or WOW (as the case may be) in relation to health and safety;
- if any WOW Services which you asssit with directly or indirectly become subject to a regulatory investigation or enquiry you agree to:
- provide Go People any reasonable assistance in relation to such investigation or enquiry; and
- only make disclosures to any third parties, to the extent that these are strictly necessary to comply with any Relevant Laws;
- you are over the age of 18 years;
- have been authorised by Go People to provide WOW Services; and
- you will perform and provide the WOW Services in a conscientious, expeditious and professional manner.
3.2 You further agree to:
- complete any mandatory National Police Checks;
- not smoke during the performance of the WOW Services;
- transport food under adequate temperature control;
- ensure that food which is intended to be transported frozen remains frozen during transportation;
- deliver any goods as instructed by Go People and WOW as shown on the goods’ label;
- not to complete any delivery for goods where you know, suspect or reasonably ought to know that the goods include alcohol and the designated recipient of the goods is not home, is intoxicated or is otherwise unable to verify that they are over 18 years of age; and
- return the goods to the location where they were collected for delivery, if the goods are unable to be delivered for any reasons, or such other address as may be notified by Go People or by WOW to you.
4. INFORMATION PROVIDED TO WOW
4.1 You acknowledge and agree that Go People will from time to time provide to WOW real time information, regarding:
- safety and other incidents involving Runners performing WOW Services;
- delivery information;
- Runner positioning (including longitude and latitude coordinates);
- Runner earnings; and
- Runner contact details if reasonably requested by WOW, to address any safety and other incidents involving Runners.
5. WOW DATA
5.1 You agree to comply with the Privacy Act 1988 (Cth) any other applicable privacy or protection laws in relation to WOW’s data (“WOW Data”), which includes:
- all data, information, text, drawings or other material, in whatever form that information may exist which:
- are accessed, collected, stored, processed, retrieved, used or generated by Go People in the course of performing the Agreement or otherwise in connection with the WOW Services;
- are supplied by a WOW Group member to the Supplier under or in connection with this Agreement or otherwise in connection with the WOW Services; or
- relate to a WOW Group member’s operations, facilities, customers, personnel, assets, programs or the Services;
- any personal information that you are provided with, collect or access in connection with the WOW Services; and
- any information that:
- relates to the business, assets or affairs of WOW (or any of its related bodies corporate);
- is made available by or on behalf of WOW to you, or is otherwise obtained by you; and
- is by its nature confidential or you know, or ought to know is confidential,
including information acquired by you solely by virtue of performing the WOW Services.
5.2 You agree not to:
- use WOW Data other than for the purpose of performing the WOW Services;
- sell, license or otherwise deal with or commercially exploit any WOW Data;
- disclose any WOW Data to any third party without WOW’s prior written consent;
- alter the WOW Data except as required to perform the WOW Services;
- store or allow the storage of or access to WOW Data outside Australia and not disclose or allow the disclosure of WOW Data to any person outside Australia, without WOW’s prior written consent;
- alter the WOW Data except as required to perform its obligations under this Agreement; or
- match or otherwise combine any personal information, which WOW or Go People provides to you in connection with carrying out the WOW Services, with any other information from any source other than WOW without WOW’s prior written consent.
5.3 Upon request, you unconditionally agree to immediately:
- securely destroy or deliver to Go People or WOW (as specified by a Go People or WOW representative from time to time) all WOW data in your possession, power or control, save for any data that you are strictly required to retain by law; and
- provide any reasons for why have retained any WOW data (in circumstances where you may be required to do so).
6. ADDITIONAL FEES
6.1 There may be additional fees payable to you:
- where you are required to wait for more than 15 minutes prior to being able to complete the pick-up as scheduled due to WOW orders not being ready at the Load Point, you will be paid $0.00 for the first 15 minutes after the scheduled pick-up time and thereafter $4.47 (ex GST) or $4.91 (inc GST) for each 10-minute unit (the “Waiting Fee”). The $4.47 (ex GST) or $4.91 (inc GST) charge for each 10-minute unit will apply even if the waiting time for each unit is less than 10 minutes. For example, a waiting time of 16 minutes from the scheduled time will incur a Waiting Fee of $4.47 (ex GST) or $4.91 (inc GST).
